What types of companies or government entities are affected by the ban?

As of now, the NDAA ban affects federal projects, federal contractors, and any security camera system that is federally funded.  Until COVID, this was a narrow area.  However, as a result of the COVID pandemic, many businesses and local governments received funds through the CARES Act, as well as through other federal programs, for improvements to their facilities.  Funds from the CARES Act or from other federal programs cannot be used to purchase surveillance systems that are banned under the NDAA.  For example, local school districts receiving CARES Act funding cannot purchase any security camera systems on the NDAA ban list with those funds.  This seems like a simple proposition, but it is not.  Many businesses and local governments are not aware of the NDAA ban and may not be aware of the restrictions on the use of those federal funds.  In addition, even those businesses and local governments that are aware of the restrictions may not know whether a product that they are interested in purchasing is part of the ban.  This is because it can be very difficult to know who the manufacturer of a security camera system is.  It can be impossible to go by just the name. 

NDAA Compliant Security Cameras 

There are hundreds of brands of security camera systems that are really just relabeled with a U.S. company’s name but the actual manufacturer is a company on the NDAA ban list, such as Dahua or Hikvision.  For example, IC Realtime who sells products in the U.S. under their brand of IC Realtime was historically just selling relabeled products made by Dahua.  This is called an OEM (Original Equipment Manufacturer).  So IC Realtime was selling Dahua OEM products and anyone that purchased those systems may have believed they were buying NDAA compliant components because IC Realtime is not specifically named in the NDAA ban list.  However, the truth is that those systems that IC Realtime was selling that were Dahua OEM products were not NDAA compliant.  Honeywell, another well known U.S. company selling security camera products, did the same thing.  In fact, this was the case with hundreds of other U.S. companies selling products under their names that were just OEM products made by overseas manufacturers.
